Privacy Policy

This Privacy Policy governs the manner in which WS Publishing Group collects, uses, maintains, and discloses information collected from users (each, a “User”) of the www.letsleapahead.com, and all Friendzy websites (“Websites”) and applications (“Apps”). This privacy policy applies to the Websites and Apps and all products and services offered by WS Publishing Group, Inc. under the names Let’s Leap Ahead and Friendzy Apps, which are owned by WS Publishing Group, Inc.

WS Publishing Group owns and creates a variety of applications, including the Friendzy apps, and more. By accessing or using the WS Publishing Group Websites or Apps, you agree to be bound by this Privacy Policy, whether or not you register as a User.

Please choose carefully the information you post or share via any WS Publishing Group App or Website and that you provide to other Users. Any text or photographs provided by you may NOT contain profanity, nudity, violence, or offensive subject matter. WS Publishing Group reserves the right to cancel any account or remove any materials from every App or Website at any time. However, information provided by WS Publishing Group App or Website Users may contain inaccurate, inappropriate, or offensive material, products, or services, and WS Publishing Group assumes neither responsibility nor liability for this material.

WS Publishing Group reserves the right, in its sole discretion, to reject, refuse to post, or remove any text or photographs, or to restrict, suspend, or terminate your access to any or all apps and services at any time, for any or no reason, with or without prior notice, and without liability.

By participating in any WS Publishing Group App game, activity, or event, you agree to release and hold WS Publishing Group harmless from any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, either directly or indirectly related to or arising from your participation in any such WS Publishing Group App activity.

Eligibility.

By using any of the Apps and the Services, you represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information.

You further represent and warrant that you are 18 years of age or older and that your use of the WS Publishing Group Apps shall not violate any applicable law or regulation. If you are under the age of 18 years old, your parent or guardian shall be responsible for any actions performed on the Apps, including, but not limited to, purchases, content, messages, photographs, and interactions on third-party sites.

The Apps you download are solely for your personal use, and you shall not authorize others to use your account, including your profile, username, or email address. You are solely responsible for all content published or displayed through your account, including any messages, original content, information, and your interactions with other members.

You cannot download or otherwise access the Apps if you are a convicted sex offender.

Term/Fees.

This Agreement shall remain in full force and effect while you use any WS Publishing Group App, any App’s Services, and/or are a User. When prompted to pay for an App or an in-app purchase, you will provide your accurate payment information and pay accordingly. Only Users over 18 years old are allowed to make any purchases. Users under this age must have their legal guardian or parent submit their accurate payment information and complete the payment process for Users that are minors.

By using the Apps’ Services and by becoming a User, you acknowledge that WS Publishing Group reserves the right to charge for any Services and has the right to terminate a User’s Service if the User should breach this Agreement or fail to pay for the Service, as required by this Agreement.

Proprietary Rights in Content.

WS Publishing Group, Inc. owns and retains all proprietary rights in the Apps and the Services. The Apps contain copyrighted materials, trademarks, and other proprietary information of WS Publishing Group, Inc. and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

The Apps contain copyrighted materials, trademarks, and other proprietary information of WS Publishing Group and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

Content Posted on the Apps.

a. You understand and agree that WS Publishing Group, Inc., may review and delete any content, messages, photos, or account profiles (collectively, “Content”) that in the sole judgment of WS Publishing Group violate this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any User.

b. You are solely responsible for the Content that you publish or display (hereinafter, “post”) on the Service or any material or information that you transmit to other Users.

c. By posting any Content to the Apps, you hereby grant to WS Publishing Group the non-exclusive, fully paid, worldwide license to use, publicly perform and display such Content in any medium, including Apps, websites, and books. WS Publishing Group has no obligation to monitor your Content.

d. The following is a partial list of the kind of Content that is illegal or prohibited on the Apps. WS Publishing Group reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service. Prohibited Content includes Content that:

i. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; 
ii. harasses or advocates harassment of another person; 
iii. involves the transmission of “junk mail”, “chain letters,” or unsolicited mass mailing or “spamming”; 
iv. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; 
v. promotes an illegal or unauthorized copy of another person’s copyrighted work 
vi. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

vii. uses the Service to harm anyone, particularly anyone under the age of 18;

viii. disrupts the Service, servers, network, or any part of the Apps 
ix. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses; 
x. solicits passwords or personal identifying information for commercial or unlawful purposes from other users; 
or xi. involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.

e. You must use the Service in a manner consistent with any and all applicable laws and regulations.

f. You may not engage in advertising to, or solicitation of, any User to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Users. Although WS Publishing Group cannot monitor the conduct of its Users off the Apps, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any User, particularly Users under the age of 18.

g. Any automated use of the Apps, such as using scripts to add friends, is prohibited.

h. You may not attempt to impersonate another User or person who is not a User.

i. You may not use the account, username, or password of another User at any time nor may you disclose your password to any third party or permit any third party to access your account.

j. You may not sell or otherwise transfer your account’s profile.

 

User Disputes.

You are solely responsible for your interactions with other WS Publishing Group App Users. WS Publishing Group reserves the right, but has no obligation, to monitor disputes between you and other Users.

Disclaimers.

WS Publishing Group is not responsible for any incorrect or inaccurate content posted on the Apps or in connection with the Service provided, whether caused by Users or by any of the equipment or programming associated with or utilized in the Service. WS Publishing Group is not responsible for the conduct, whether online or offline, of any App User. WS Publishing Group assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User communication or App function. WS Publishing Group is not responsible for any problems or technical malfunction of any telephone network or lines, online systems, servers or providers, equipment, software, failure of any email or players due to technical problems or traffic congestion or combination thereof, including any injury or damage to Users or to any person’s device (mobile phone, tablet, computer, etc.) related to or resulting from participation or downloading materials in connection with an App and/or in connection with the Service. Under no circumstances shall WS Publishing Group be responsible for any loss or damage, including personal injury or death, resulting from use of an App or Service or from any Content posted on the Apps or transmitted to Users, or any interactions between Users, whether online or offline. The Apps and the Service are provided “AS-IS” and WS Publishing Group expressly disclaims any warranty of fitness for a particular purpose or non-infringement. WS Publishing Group cannot guarantee and does not promise any specific results from use of the Apps/or the Service.

Virtual Goods and Currency.

The Apps may at any time include virtual coins, points, or other monetary system with which Users may “purchase” virtual goods. The value system of the virtual currency is created by WS Publishing Group and is subject to change at any time. At no time will the virtual currency or achievements be cashed in for physical money, nor will the virtual currency be accepted anywhere outside the Apps.

 

Limitation on Liability.

IN NO EVENT SHALL WS Publishing Group BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE APPS OR THE SERVICES, EVEN IF WS Publishing Group HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Disputes.

If there is any dispute about or involving the Apps and/or the Services, by using the Apps, you agree that any dispute shall be governed by the laws of the area in which we are based without regard to conflict of law provisions and you agree to personal jurisdiction by and venue in the area in which we are based.

Indemnity.

You agree to indemnify and hold WS Publishing Group, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our Websites or Apps, register on the Websites or Apps, subscribe to a newsletter, fill out a form, and in connection with other activities, services, features or resources we make available on our Websites or Apps. Users may be asked for, as appropriate, name, email address, mailing address, and phone number. Users may, however, visit our Websites or Apps anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Websites or Apps-related activities. WS Publishing Group is not responsible for any personal information obtained by other parties via illegal methods, including, but not limited to, hacking. It is the User’s responsibility to enter information in a safe environment and via a safe Internet connection. The information WS Publishing Group collects can include, but is not limited to, the User’s:

b. First initial of last name

c. Country

d. Email address of a parent or guardian (optional)

e. Username

f. Password

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Websites or Apps. Non-personal identification information may include the browser name, the type of computer, and technical information about Users’ means of connection to our Websites or Apps, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies

Our Websites or Apps may use “cookies” to enhance User experience. [Users’ web browsers place cookies on their hard drives for record-keeping purposes, Users may choose to set their web browsers to refuse cookies, or to alert them when cookies are being sent. If they do so, some parts of the Websites or Apps may not function properly.

How we use collected information

WS Publishing Group may collect and use Users’ personal information for the following purposes:

 

- To improve customer service

Information you provide helps us respond to your customer service requests and support needs more efficiently.

- To personalize user experience

We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Sites.

- To improve our Sites  

We may use feedback you provide to improve our products and services.

We may use the email address provided by Users to send User information and updates pertaining to their orders or send information about other company’s products. It may also be used to respond to their inquiries, questions, and/or other requests. If Users decide to opt in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time a User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email. The User may also contact us via our Websites or Apps.

Personal information is used for the betterment of the User’s experience. This includes, but is not limited to:

·       Displaying the top competitors and the top competitors’ countries and schools in worldwide games and competitions

·       Saving results and original content to servers so it may be accessed later and via different devices

·       Sending push notifications

·       Requests for customer feedback

WS Publishing Group is not responsible for any personal information obtained by other parties via illegal methods, including, but not limited to, hacking. It is the User’s responsibility to enter information in a safe environment and via a safe Internet connection.

Purchases

If the User chooses to make a purchase through one of the Apps or Websites, such as an in-app purchase, the User must enter his or her correct credit card information and billing address. This information will only be used to complete the purchase transaction. The information will not be shared with any other parties, nor will it be used for any action other than the action for which the User has entered it.

While WS Publishing Group will ensure that your credit card and billing information is only used for purchases the User chooses to make, WS Publishing Group is not responsible for any devices getting hacked or information getting stolen in any way. It is the User’s responsibility to enter sensitive information in a safe environment under a safe Internet connection.

How we protect your information

We adopt appropriate data collection, storage and processing practices, and security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal information, username, password, transaction information, and data stored on our Websites and Apps.  If the company gets sold or merged with another company, we will notify our users of the transaction, and ask the new partner or buyer to abide by the same Privacy Policies.

Our Websites and Apps are in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users.

Sharing your personal information

We do not sell, trade, or rent Users’ personal identification information to others.

Third-party websites

Some users may find advertising or other content on our Websites or Apps that links to the sites and services of our partners, suppliers, advertisers, sponsors, licensors, and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Websites or Apps. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites that have a link to our Websites or Apps, is subject to that website’s own terms and policies.

Changes to this privacy policy

WS Publishing Group has the discretion to update this privacy policy at any time. When we do, we will notify all our users of the changes via email if the user has a valid e-mail. We encourage Users who do not include their e-mail address to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your acceptance of these terms

By using these Websites or Apps, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use our Websites or Apps. Your continued use of the Websites or Apps following the posting of changes to this policy will be deemed your acceptance of those changes.
